Brian Beverly was elected president of the North
Carolina Association of Defense Counsel for 2008-2009 at NCADA's annual meeting
June 12-15, 2008. Brian has also been selected for membership in the International
Association of Defense Counsel.
Glenn Raynor presented
"Professional Responsibility Issues Arising in Insurance Coverage Claims" and
"Homeowners Insurance Coverage Issues" for the Wake Forest University School
of Law Continuing Legal Education program Insurance Law 2008 on March 7, 2008.
Bob deRosset has been
certified by the North Carolina Dispute Resolution Commission as a Superior Court
mediator.
Donna Rutala presented "Trends
in Medical Malpractice Litigation- Past, Present and Future" at the North
Carolina Association of Hospital Risk Managers Spring 2008 meeting May 7-9.
Walter E. Brock, Jr., and Matt Gray
were recently successful in the North Carolina Court of Appeals in a fraud
and misrepresentation case arising out of the burning of a residence in Richmond
County. The Court of Appeals affirmed summary judgment for the defendants
N.C. Farm Bureau Mutual Insurance Co. and its agent, finding that the insureds
had knowingly misrepresented material facts in their application for property
insurance. The case is significant because it affirms summary judgment
in a misrepresentation case involving a fire insurance policy, recognizing
that the issue of misrepresentation in an application for fire insurance does
not necessarily present an issue of fact barring summary judgment.

Young Moore and Henderson is pleased to announce that Adam Tarsitano,
Knicole Allen, Kelly Street and Michael Rainey
have joined the firm as associates. Adam has practiced in the area of defense
litigation in New York City and Raleigh and managed tort litigation for AIG.
He is on the firm's insurance coverage litigation team and also handles retail
and premises liability and construction cases. Knicole has practiced in Atlanta
in products liability and mass tort defense. Kelly practiced in Texas before
coming to Raleigh. She and Knicole are on the firm's medical malpractice litigation
team. Michael has been a litigator with a firm in New Bern since graduating
from Campbell University Law School in 2007. He will focus his practice on
trucking and transportation law.
Walter E. Brock, Jr. was
among several speakers, including Governor Mike Easley, Chief Justice
Sarah Parker and former Chief Judge Gerald Arnold, at the observance
of the 40th anniversary of the North Carolina Court of Appeals. He was a law
clerk for one of the court's original judges, then Chief Judge Naomi
Morris, and the son of the late Chief Judge Walter E. Brock. His remarks
ranged from personal recollections to historical and professional observations
on the development of the court.
William M. Trott has been
appointed to the Board of Directors of ALFA
International legal network. With 125 member law firms throughout the United States and around
the world, ALFA is the oldest legal network of its kind and remains one of the
largest. Bill has served ALFA International in a number of positions in past
years including on the Labor and Employment Editorial Board.
