Environmental Litigation
Young Moore and Henderson provides legal services in litigation and in administrative proceedings based on state and federal environmental statutes and regulations, common law nuisance and trespass, and toxic torts. Our experience includes federal Superfund/CERCLA and RCRA, federal asbestos regulations, state underground storage tank statutes and regulations, state sedimentation control regulations, state groundwater regulations, and the Oil Pollution and Hazardous Substances Control Act.
The firm assists clients in obtaining available insurance (see section on Insurance Coverage Practice Area) and in qualifying under the Commercial and Non-commercial UST Funds for reimbursement of expenses to assess and remediate contamination.

The firm provides clients emergency response advice in the event of the release or discovery of the release of contaminants involving their property, vehicles, or equipment.
Our environmental trial lawyers also combine their experience with that of the firm's real estate and business attorneys to advise clients and prepare appropriate documents for transactions involving property impacted or potentially impacted by pollution, and to assist clients in obtaining and understanding environmental assessments.
We recognize the imperative of protecting the environment and the harsh consequences to owners, operators, and transporters if a proper response is not undertaken to a pollution event. However, we also know that settling upon a cost-effective assessment and remediation with the responsible government agency often requires knowledgeable cooperation and effective advocacy.
Finally, we understand the disruption and expense to a business faced with potential environmental liabilities. To address these concerns, the firm assists clients in identifying realistic goals and objectives, and utilizes its litigation and alternative dispute resolution experience to work toward a prompt, cost-effective resolution to disputes.
