Insurance Coverage Analysis and Litigation/Bad Faith Litigation
Young Moore and Henderson represents individuals, companies and insurers in disputes arising out of all types of insurance: business and personal auto liability and UM/UIM insurance, general liability insurance, employer's liability insurance, umbrella/excess insurance, reinsurance, commercial and homeowners property insurance, environmental impairment liability insurance, professional liability insurance, and life, health and accident insurance. The firm provides insurance coverage advice and legal opinion letters in each of these areas.
The firm also has experience in arson and fraud litigation, and conducts the examinations under oath that are often required in the fraud or arson investigation. We encourage and enjoy the opportunity to participate in such claims from the earliest possible date in order to provide privileged advice to the insurer and to assist in developing and evaluating the evidence. We are then in a position to advise the insurer on its alternatives against the background of its experience in the trial of first and third party contract and bad faith litigation. The firm understands and appreciates the risks to the industry of claim denials based on fraud and arson, and assists the companies in a realistic evaluation of the claim.
Members of the firm regularly appear in the state and federal trial and appellate courts to address insurance coverage issues that have implications throughout the state. There are numerous published opinions involving cases handled by members of the firm in cases involving all types of insurance.
The firm has particular expertise and insight into automobile liability, homeowners insurance, and employer's liability insurance through its representation of the North Carolina Rate Bureau, the agency responsible for writing and obtaining regulatory approval for the standard policies used in North Carolina. We have represented the Rate Bureau since its creation in 1977, during which time it has participated in the development of policy forms and has worked with the Department of Insurance to obtain approval for policy form revisions.
