Tobin Obtains Unanimous Defense Verdict in a Wrongful Death UIM Arbitration

Jay P. Tobin successfully obtained a unanimous defense verdict on behalf of a UIM carrier in a three-judge arbitration arising out of wrongful death lawsuit. The case involved a single vehicle accident in which the estate of the deceased passenger sued the driver of the vehicle for proximately causing the death of the passenger. The successful defense was based on the deceased passenger’s contributory negligence for voluntarily getting into the vehicle after the passenger and driver had been consuming alcohol together.
