As the COVID-19 pandemic continues, law enforcement authorities are increasingly taking action under anti-price gouging and anti-hoarding provisions of federal and state law. A wide range of businesses, including, but going beyond the sellers of medical equipment, should be aware of the limits imposed by these statutes and the dangers posed by enforcement. This webinar provides an overview of applicable law and strategies to prepare for and respond to claims or inquiries by federal and state authorities.

Panelist - Robert Bertram, General Counsel for Ollie's Bargain Outlet, Inc.

ROBERT BERTRAM is the General Counsel for Ollie's Bargain Outlet, Inc. ("Ollie's"). In that capacity, he is responsible for overseeing the diverse range of legal, and many business affairs involving the company. Based in Harrisburg, Pennsylvania, Ollie's is one of America's largest retailers of closeouts, excess inventory, and salvage merchandise. Ollie's has more than 235 "semi-lovely" warehouse style stores, located in 20 states, offer and sell a broad variety of merchandise to an intensely loyal, and growing customer base. Prior to joining Ollie's in 2014, Rob was an attorney in the corporate department of ALFA International member firm, McNees, Wallace & Nurick, LLC, in Harrisburg, PA, where he represented both growth and well established companies. Rob attended the Pennsylvania State University ("Penn State"), attaining a degree in economics, and received his JD from The Dickinson School of Law. He speaks frequently on both contracting and corporate governance issues. Rob is a youth soccer coach, and mentors undergraduate students at Penn State.

Panelist - John H. Newcomer, Jr., Morris James LLP

JOHN H. NEWCOMER JR., is a partner at Morris James LLP, ALFA International's member firm in Wilmington, Delaware, and serves on the firm's Executive Committee. John practices in the areas of commercial litigation and real estate. His experience in these dual fields provides his clients with a rare perspective in dealing with complex business and real estate matters. Understanding the dynamics of litigation, and how it impacts his clients' business strategies, gives John the ability to draft transactional documents with an eye towards avoiding problems before they arise. John's litigation practice involves a wide range of business, contract, and real property disputes. His experience as a certified mediator of the Delaware Superior Court gives John the additional insight to resolve his clients' disputes before they turn into costly litigation. Outside the practice of law, John enjoys riding motorcycles locally, nationally and internationally. John currently serves on the ALFA International Business Litigation Steering Committee and was the 2019 Program Chair for the Business Litigation Seminar.

Panelist - Mark S. Olinsky, Sills Cummis & Gross P.C.

MARK S. OLINSKY is a member of ALFA International member firm, Sills Cummis & Gross P.C. in Newark, New Jersey and has been a civil and criminal trial lawyer for more than thirty years. He served as a federal prosecutor in the Office of U.S. Attorney Samuel A. Alito, Jr. and is Past President of the Association of the Federal Bar of New Jersey. Mark’s diverse case load includes complex business disputes, health care litigation, and white-collar criminal defense. His courtroom experience includes many jury and bench trials, arbitrations and appeals, and his expertise includes defense of federal and state RICO actions. He has conducted numerous corporate internal investigations and has represented both individuals and corporations in a wide variety of government investigations, particularly in the health care and pharmaceutical industries. He has successfully represented large health care systems and high-level executives in recent investigations involving alleged violations of the False Claims Act, the Anti-Kickback Statute, and other federal health care statutes and regulations.
