Appellate Practice

Young Moore attorneys are experienced at every step of the litigation and appeals process in both state and federal courts. We pride ourselves on the ability to guide every matter from inception through final resolution under one roof.

Successful appellate advocacy begins well before an appeal is filed. Our attorneys leverage both trial and appellate experience to strengthen our clients’ position at every stage of litigation, and we approach every matter with a prospective vision of our clients’ long-term goals. From pre-trial motions, to trial rulings, to post-trial motions, we work to prevent trial court errors so as to minimize litigation costs. We prepare arguments and draft orders with an eye toward ensuring they will withstand scrutiny on appeal. When necessary, we know how to effectively preserve any errors in the event an appeal must be pursued. We also have the sophisticated understanding of the appellate procedural rules needed to guide matters effectively once an appeal has been filed.

Our attorneys routinely appear before the North Carolina Court of Appeals, the Supreme Court of North Carolina, and United States Court of Appeals for the Fourth Circuit on appeals from our trial courts and administrative bodies. The practices in which we have particular appellate experience include insurance rate making, business litigation, workers’ compensation, insurance defense, insurance coverage and bad faith, medical malpractice, legal and other professional malpractice, administrative law, construction litigation, employment discrimination, and transportation. While our trial lawyers remain lead counsel through the appeals process, we also have attorneys with a special focus on the intricacies of appellate practice to support a complete team effort in pursuing or defending an appeal.

Our firm’s commitment to effective appellate advocacy has earned a valuable reputation in the legal community. Because of our depth of talent, experience, and reputation, industry groups often request that our attorneys appear on their behalf as amicus curiae in high-stakes appeals. We also receive assignments from clients to take over cases on appeal, and from other lawyers and law firms who trust our attorneys to carry the case through the appeals process with integrity and vigor.

Although outcomes can never be guaranteed, we have built a reputation to ensure that when Young Moore attorneys appear before our appellate courts, the courts can expect exceptional appellate advocacy.
