Insurance Coverage & Bad Faith Litigation

We counsel insurers on coverage.

At Young Moore, we represent individuals, businesses, and insurers in disputes arising out of all types of insurance. These include business and personal auto liability, uninsured or underinsured motorists, general liability, employer’s liability, employment liability, environmental impairment liability, professional liability, director’s and officer’s (D&O) liability, errors and omissions (E&O) liability, umbrella/excess liability, and reinsurance.  We also represent individuals, businesses and insurers regarding property and inland marine insurance, including commercial and homeowners.   Finally, we handle life, accident and health insurance disputes. For each of these areas of insurance law, we provide coverage advice, legal opinion letters, and litigation counsel.

At Young Moore, we also have deep experience in arson and fraud investigations and litigation. We conduct examinations under oath, evaluate evidence developed in investigations, and advise clients on their rights and responsibilities. We participate in such claims at the earliest opportunity so that we can provide realistic advice to insurers based upon our experience in the litigation of numerous first- and third-party contract and bad faith actions. We understand and appreciate the risks to insurers arising from claim denials based on fraud and arson.

We regularly appear in state and federal trial and appellate courts and the Department of Insurance to address insurance coverage and bad faith issues that have implications across North Carolina. The firm has numerous reported decisions in both state and federal appellate courts on a broad range of insurance issues.

Our ongoing representation of the North Carolina Rate Bureau provides unique insight into automobile liability, homeowners, and employer’s liability insurance. The Bureau is responsible for writing and obtaining regulatory approval for the standard insurance policies in North Carolina. In representing the Bureau for more than 25 years, we have participated in the development of policy forms and have worked with the Department of Insurance to obtain approval for policy form revisions.

Finally, we also assist individual insurers in drafting, revising and updating their policy forms and endorsements for a broad range of insurance from property to professional liability.
